May 4, 2020 Reports

The Board of Directors of Buena Vista Lakes Maintenance Association met May 4, 2020; at 7:00 p.m. Ned Plunk called

the meeting to order and Larry Wilson led the assembly in prayer.

A roll call of board members was requested. Present were: Ned Plunk, Teri Rowell, Richard Gatlin, Billy St. Cin, Larry

Wilson, Diane Barber, Steve Shifflett, Donna Depukat, Vicki Moore, and Secretary-treasurer Christy Chavez. A quorum

was established.

MINUTES: The Minutes of the Monthly Meeting of April 6, 2020 were reviewed by the directors. A motion was made

to accept the minutes, seconded and passed unanimously.

FINANCIAL REPORTS: The Monthly Financial Statement of April was reviewed. The motion was made to accept

the financials with no changes. The motion was seconded and passed unanimously.

Finance:

 No report from the attorney due to covid-19.

Neighborhood Watch:

 Ms. Moore reported the following calls:

 1 theft

 1 welfare check

 1 DOA

 2 disturbances

 1 noise complaints

 1 overdose

 1 residential alarm

 1 animal complaint

 1 civil matter

 Non-emergency calls can be made to DeSoto County Sheriff’s Department at 662.469.8599.

Recreation: Pool, Ballfield, Playground:

Playground & Ballfield:

 Ms. Barber reported that she is in the process of repairing the playground slides.

Pool

 Mr. Wilson reported that he would set up an appointment to have the pool cover removed and ready so that

when state restrictions are lifted the pool could be opened to the residents.

 It was agreed that state guidelines would be followed and that two (2) months’ worth of chemicals be

purchased at a time.

Clubhouse:

 Mr. Shifflett reported that there has not been a lot of activity due to the coronavirus.

Publicity: Orange Book, Beautification/Sanitation/Building Permits & Greeter:

Orange Book

 No report.Beautification:

 Mr. Pethtel reported:

o 8870 Bobwhite is making progress.

o 8838 Bobwhite has undergone a noticeable upgrade.

o Four new properties will be notified for violations.

o The new brick entrance sign is beautiful.

o Spillway #2 has had a lot of cars that are parking on the grassy areas.

o Be safe and keep an extra eye out for any neighbors that may need help.

o The board agreed that citation letters are to be sent to anyone in violation of county or orange book by

regular mail

o A copy of the letter and a picture of the violation will be kept on file for BVL record. Letters will be kept in

lot number order so that lot occurrences can be easily tracked.

o The letter will indicate the violation, i.e. travel trailer parked in front yard, falling down porch, excessive

height grass, etc.

o The letter will give residents 2 weeks to correct the issue.

o If no action is taken after 2 weeks, the property(s) that are in violation will be brought before the board. At

this time the board will assist in selecting the 4 worst cases. A copy of the citation letter and a copy of the

pictures will be mailed to Benny Hopkins, Director of Planning, by certified, return receipt requested with a

cover letter stating that Buena Vista Lakes would like the county to take action in getting the 4 issues

resolved

and

o A copy of the letter notices with pictures and copies of the letter to Benny Hopkins should also be sent by

postal mail or email to Michael Lee, and the BVL attorney (The letters should reflect that a copy is being

sent to Michael Lee and the BVL attorney).

o After these 4 properties are resolved then the process will repeat for the next 4 worst cases. Additional letters

(other than the 4 chosen) can and should be sent to violators giving 14 days, however only the 4 worst will be

sent to the county so as not to bombard them.

o Code violations can be reported to Bennie Hopkins @ BHopkins@desotocountyms.gov and/or Michael Lee

Permits

 Ms. Moore reported no new requests.

Greeter

 The motion was made and passed to purchase two (2) sets of letters for the front entrance board. The motion

passed 9-0.

Mowing

 Mr. Moore reported that the mowing has began and is going well.

Maintenance: Lakes & Dams & Mowing:

Lakes & Dams

 Mr. Shifflett reported that Mr. Pionk assisted with work on the lakes and dams.

 The culvert at spillway #1 is in need of cleaning out.

 Ways to prevent corrosion is being explored.

 Mr. Shifflett reported that there has been a lot of atv traffic on the dams. Deterrence’s are being researched.

 Mr. Shifflett presented the following recommendation from the lakes and dams engineer:

o After review and consideration of options to repair the spillways on the lakes, the engineer’s

recommendations are listed below:Note that these recommendations are subject to MDEQ-Dam Safety approval; a permit from them is

required. No action should be taken (other than emergency action) prior to obtaining the permit.

o Two options were considered:

 Removal and replacement of the existing concrete spillways

 Filling the voids under the concrete, repair and patching damaged concrete, and re-surfacing

the existing spillways

 Removal and replacement is not recommended due to the much higher cost, complexity of

replacing spillways on a slope, and partial draining of the lakes to expose the concrete below

water level where applicable. Filling the voids under the concrete, repair and patching

damaged concrete, and re-surfacing the existing spillways is recommended. Spillway

priorities based on the condition of the spillways after holes were bored and viewed with the

investigative camera, and consultation with contractors is as follows:

 Deer Track Spillway – Spillway No. 1

 Rain Cloud Spillway – Spillway No. 2

 Thunderbird Spillway – Spillway No. 3*

 The condition of Thunderbird spillway is as critical as Rain Cloud, but it is classified

as a low hazard lake and not under the strict jurisdiction of MDEQ-Dam Safety, thus

it can be addressed last. However, it does need attention as soon as possible.

o Generalized construction actions needed for each spillway in order of work to be accomplished are:

 Fill the voids under all spillways with a specialized polyurethane foam. This will prevent

further erosion of the voids and should prevent water from flowing under the spillways. A

quote from a qualified contractor is attached for this work. Other options for filling the

voids were considered: 1) Drilling holes through the concrete and pressure grouting with a

concrete mix; 2) installing several concrete cutoff walls in each spillway, filling the voids

with concrete. (Estimates have been provided to BVL by one contractor); 3. Filling the

voids with polyurethane in accordance with industry and government standards.

 Address the joints in the spillways by a method compatible with no 3 Below.

 Repair damaged concrete where necessary and overlay the existing concrete with a high

strength lightweight concrete mix.

 Note that the addressing joints and overlay are separate operations and not included with the

quote for filling the voids under the concrete spillways.

 Mr. Shifflett reported that the would be $20 for filing of the plans with MDEQ, $5,300 for the engineering

fees, $67,427.50 for the construction actions. Mr. Shifflett explained that this process would eliminate the

need to seal the cracks and joints, which has been a concern due to expense and method.

 Ms. Rowell made the motion to approve up to $72,747.50, beginning with the spillways that are in the most

need. Billy St. Cin seconded the motion, the motion passed 8-0.

Clubhouse

 Ms. Moore made the motion to increase the clubhouse rental fees to $100, the motion was seconded and passed

8-0.

Fourth of July Celebration

 The request was made to allow Love Church to donate funds and participate in the 4th of July celebrations. The

board agreed that due to the many churches that assisted during the tornado, picking one church over another

would not be fair. The board agreed that the 4th of July celebration is a time for BVL residents and their

immediate families.

 Ms. Moore made the motion to approve $450 to the food expenses for the 4th. Mr. Gatlin seconded the motion.

The motion passed 8-0.

 It was requested that residents please cleanup discharged fireworks and trash before they leave.The motion was made and seconded to adjourn the meeting at 8:49 p.m.
