Minutes for June 6, 2022
The Buena Vista Lake Maintenance Association Board met for its regular monthly meeting on Monday June 6, 2022 at 7pm at the community clubhouse.
The meeting was called to order by President Ned Plunk; members present included: Ned Plunk, Vicki Moore, Melanie Turner, Kyle Cornish, Leigh Cornish, Kevin Cooper, Nathan Naramore, Chris Vanelli, Joel Bales, Moriah Mozingo. Members absent were Barbara Campbell, Kim Wood, and Larry Wilson. A quorum was confirmed.
Visitors included: Donna Miller, Izolde Alexander, Ann Plunk (Acting Secretary)
A Benevolence Fund collection was made. Current funds are $617. A motion was made and seconded to provide Kim Wood with $200 to assist her in travel expenses as she assists her mother at MD Anderson Cancer Center in Houston, TX. Motion was passed unanimously.
Old minutes of May 2022 were read by board members with motion made and seconded to accept as read. Motion passed unanimously.
Financial Report for April 2022 – motion and seconded to approve as reported in the Keith Collins portal.
COMMITTEE REPORTS:
FINANCE: Moriah Mozingo. Ronda Wilson (Keith Collins) has contacted our attorney Brad Palmertree regarding collection of unpaid dues. 10-day demand letters have been sent to some delinquent homeowners while Mr. Palmertree continues to process down the list. We still have approximately $33,000 in outstanding dues from approximately 20 homeowners. A “sanitized” version of the financial report is available on the Keith Collins portal site for any homeowner seeking information. As of April 30, 2022 dues were $51,000 in arrears, and this has been lowered to $33,000 on May 23rd.
Homeowner Donna Miller asked a question about a judgement on the foreclosure property on Chickadee Cove; there is no one to go after for the money. We could go after a judgement lien, but this will be inferior to a mortgage lien. There appears to be a judgement from 2016 in Chancery Court, which is against a person, while a lien is against a property. But there is no one to pay any judgement on this particular property.
The property which has a garnishment against the homeowner has paid $2024.38 to date.
NEIGHBORHOOD WATCH: in the absence of Kim Wood, Vicki Moore reported 33 extra patrols, and items such as a motor vehicle accident, a boat/trailer stolen, another dog bite, etc. See attached list. There will be a court date hearing on June 21 at 9am for the homeowner arrested and charged with vandalism on the levee. All board members are encouraged to attend. BVL is R-1 zoning per
DeSoto County, and as such we do have leash laws and possibly a noise ordinance for constantly barking dogs, although this appears to be for Hernando only and not the county. However, a lawsuit can be filed against a chronic offending pet owner. For issues with animals, please call DCSO and Animal Control and request a report be filed. If necessary, record the barking dogs. Questions arose regarding 4-wheelers and motorized scooters; what is permitted in BVL. Other communities have designated golf cart districts, etc. Our posted speed limit is 25mph, and for now, ATVs and other vehicles are not legal on county roads.
RECREATION: In the absence of Larry Wilson, Vicki Moore reported that the pool is open. There has been an incident of serious mess in the public bathroom, in which the offender cannot be determined on the security cameras. It is requested that if you or your child has a bathroom accident, please clean it up; we do not have a cleaning service. Comments were made regarding the pool tables, umbrellas, chairs, etc. Newer is nicer, and homeowners in the community have offered to make donations. Mr. Wilson can form a committee if needed. Chris Vanelli and Melanie Turner have shade covers that can be donated if needed.
CLUBHOUSE: Vickie Moore reported that Thursday is the inspection for materials and repairs should begin this week. We continue to need to keep the AC on 70 to control the humidity and prevent mold and mildew growth. The possibility of ordering a second dehumidifier was mentioned, as we need the rooms kept cold and dry. The AC seems to need frequent checking for reboots and resets – is this related to power outages or power surges? Kevin Cooper mentioned WiFi for the clubhouse, which unfortunately will probably be at a commercial rate. We could call ComCast and ask about a non- profit rate? This will need to be budgeted into next year’s budget. Kevin will investigate but initial estimates seemed to be $120-$150/month. Kyle Cornish asked if the water company had any internet access at their treatment plant, and if so could we share with them? It was mentioned that the clubhouse, the mailbox, and the storage shed all should potentially be re-keyed.
ORANGE BOOK: Melanie Turner – the new format has been typed up but now needs more changes added. It can be made email accessible, put on the portal, and on the website when and if it is approved. We have received feedback from the attorney Mr. Palmertree on the proposed fine schedule for Orange Book violations. He doesn’t really know that we can’t fine, or that we shouldn’t fine; as long as (1) the fines don’t exceed dues, (2) make all fines concise and consistent, and (3) accept that we may be challenged legally on the issue. Leigh Cornish has a sample fine schedule. BVL has no precedent for this type of fines; we can ask Keith Collins if they have a fine schedule or if any of their other communities have one? This will need to be drafted as a by-law and voted on at the October Annual Meeting.
BEAUTIFICATION: Leigh Cornish showed an example of the fine schedule and warning letter that accompanies it. We would set firm time frames and firm dollar amounts to suit our needs and be consistent. Ms. Miller questioned whether MS Code has a fine schedule, or would DeSoto County have one that we could reference.
BUILDING PERMITS: Chris Vanelli presented two requests. Steven Pionk requests a change in his fence from chain link to privacy and an extension (still behind his house). The motion was made and seconded to approve this permit and passed unanimously. The grandson of the deceased homeowner of properties on Black Bear Cove and on Bob White requested permission to place a dumpster for cleanup of properties. He is working on back dues, and is preparing the properties for
sale, as he knows he cannot rent them out. Ms. Vanelli has his contact information. It is not necessary to have a permit for a dumpster like this so no action was taken.
GREETER: in the absence of Barbara Campbell, no update was provided. It was noted that in all cases of visitations, two people should go to visit newcomers and provide an Orange Book. Paperwork that is also provided on BVL information needs to be updated.
MOWING: Kyle Cornish reported that all is going well.
LAKES & DAMS: Joel Bales, Kevin Cooper, Nathan Naramore reported that there is a plan in place now to replace the spillways over the course of 2 to 3 years. #2 spillway (Green Duck Levee) will be first, this year. It will require a dry weather window to proceed, and will involve a draw down of Thunderbird Lake. This will enable us to replace lost concrete due to erosion, with resurfacing, as a replacement vs a structural change. This is a good plan moving forward, with which Kelee helped greatly with her engineering skills, and is approved by the dams engineer Steve Wilson. We are seeking bids, with one already for $27,535 and looking for two more. Mr. Steve Wilson will oversee the entire project over the entire time. In light of these repairs, we have received good news on the grant money which it looks like it will come through. This will pay for 65% of costs, with BVL responsible for 35% (instead of 100%). The grant money could be as much as $300,000 per dam (#1 and #2 only) but BVL would still owe 35% or $100,000. It would cover engineering fees, etc. Mr. Wilson will fill out all the paperwork and will come to the July meeting for questions. The grant will only cover dams #1 and #2 (the high risk dams) which is unfortunate because #3 is the worst one. A rough estimate of repairs is $45,000 although Mr. Wilson hasn’t looked deeply into it yet. It is not at a catastrophic level yet, as the front of the dam on the lake side is secure and solid. The back of the dam has more potential for erosion. Joel Bales toured the inspection of the dams with Mr. Wilson; the injection of foam and patchwork with tar has each dam controlled for water for now.
For the major repairs, Green Duck Levee will need to be closed as the water is drained down in Thunderbird Lake. We will need to get the county road department involved. The process will involve a rapid-cure element instilled in the concrete which speeds up the cure time 3 to 5 fold.
For the #1 dam and levee, the old damage was repaired years ago. There is a new state ruling that trees have to be cleared to clear 50 feet from the toe of the dam. All trees north of the dam technically have to be cleared, which could be approximately 2 acres of trees. There are also 10 to 15 feet on the other side of #1 dam to be cleaned up as well. This may also require a special certification, as we can’t just cut down the trees and grind the stumps, as the roots would leave water channels that could lead to damage to the dam. We can use grant money for this. We would need to get three bids for the tree cutting and also include the erosion control. We must plan for all this in future budgets. And insurance policy will NOT help with this.
Mr. Wilson is writing up his report and will turn it in to the state. Then he will do the write-up for the grant, which is due July 15.
A complaint was noted from Krista McMillen on Bob White (8721 Bob White, lot 102) complaining about erosion that she said BVL needed to repair. There is an issue of erosion there which would require some serious dirt work, but it is on her property and not on BVL common property.
Mr. Cooper reported that the first fishing pier, on Green Duck Levee, is done and looks good; it doesn’t appear to be 32 inches wide at the ramp as required for ADA and the construction crew will return to look at it.
Mr. Naramore reported that Ms. McMillen (lot 102 on Bob White) has an abandoned boat in very poor condition on her property that needs to be removed.
Donna Miller questioned the budget available to repair the dock near Black Panther Cove, as well as the total amount paid for the Green Duck dock ($9400). The Black Panther dock does need to be removed and rebuilt, but will be relocated to a more central location.
Mr. Naramore reported that the signs have all been ordered for the levees and the golf course property and will arrive Thursday.
LADIES CLUB: Kathy Fink – The Ladies Club voted to donate $1000 to go to the repairs on the clubhouse. She reported on the upcoming July 4th plans, that no food will be served other than snow cones and popcorn and soft drinks. The Ladies Club will organize the parade and will host the games as usual. Please contact Kathy Fink to volunteer. Mrs.Fink gave an update on the Memorial Day ceremony, as well as updated on the new flag pole and new flag.
UNFINISHED BUSINESS:
Mr. Plunk reported that the pending court case is still not on the docket. Mr. Jones has hired an attorney, and they hope to have a date worked out and case resolved by August.

There being no new business, a motion was made and seconded to adjourn which passed unanimously.
