MAINTENANCE ASSOCIATION, INC.

September 14, 2020

The Board of Directors of Buena Vista Lakes Maintenance Association met September 14, 2020; at 7:00 p.m. Ned Plunk

called the meeting to order and Larry Moore led the assembly in prayer.

A roll call of board members was requested. Present were: Ned Plunk, Vicki Moore, Larry Wilson, Richard Gatlin,

Diane Barber, Steve Shifflett, Teri Rowell, Larry Moore, and Secretary-treasurer Christy Chavez. A quorum was

established.

MINUTES: The Minutes of the Monthly Meeting of August 3, 2020, were reviewed by the directors. A motion was

made to accept the minutes, seconded, and passed unanimously.

FINANCIAL REPORTS: The Monthly Financial Statement of August was reviewed. The motion was made to accept

the financials with no changes. The motion was seconded and passed unanimously.

Finance:

 Ms. Vicki Moore made the motion to have the attorney send out notice of foreclosure to lot owner xxx, Ms.

Campbell, seconded the motion. The motion passed 8-0.

 Mr. Shifflett made the motion to have the attorney send out letters to delinquent residents and proceed with

the collection process, Mr. Gatlin seconded the motion. The motion passed 8-0.

 The board requested that an email be sent to the association attorney and confirm the ability, procedure, and

fees involved in the foreclosure process.

Neighborhood Watch:

 Mr. Gatlin had nothing new to report.

 Ms. Vicki Moore reported 8 calls to the DeSoto County Sheriff’s Department.

 Non-emergency security calls & concerns can be made to DeSoto County Sheriff’s Department at

Recreation: Pool, Ballfield, Playground:

Playground & Ballfield:

 Ms. Barber reported that although she will be revolving off the board she will be an ever-present member of

this great community and will volunteer for any committee as needed. Ms. Barber will also complete the

ongoing repairs to the playground.

Pool

 Mr. Wilson reported that the pool gate has been locked as the pool season has ended.

Clubhouse:

 Donny Plunk reported:

 No rentals in September, one upcoming rental for October.

 The recent termite inspection revealed some disconnected duct work. An inspection of the findings

will take place in the upcoming days.

 No cameras were installed due to the heat.Publicity: Orange Book, Beautification/Sanitation/Building Permits & Greeter:

Greeter

 Ms. Campbell reported meeting with one new family.

Mowing & Grounds

 Mr. Moore reported that the grass season has gone well.

Maintenance: Lakes & Dams:

 Mr. Shifflett reported:

 A special thank you was given to Donny Plunk for assisting with tarring the cracks and holes on

spillway #3.

 A special thank you was given to Steve Pionk for assisting with clearing grass, and dirt on top of

spillway #3 and for assisting with the beaver hunt.

 A special thank you was given to Richard Gatlin for assisting with sweeping and cleaning the

downslope of the bottom of the spillway and assisting with traffic during the filling of voids.

 Removed dirt, grass and debris from cracks, and surface of spillway #2.

 Assisted Bulldog Construction with the filling of voids. Bulldog Construction was able to complete

the job for the amount bid in the original invoice.

 Working on doing some repairs on the docks as they are getting older.

 The boat ramp could use some additional gravel.

 In the process of inspecting #1 dam, some damage was observed. It was discovered that a resident

had to have some trees removed at which time the tree removal company pulled the trees across BVL

common area causing the damage. It was agreed that the homeowner would be contacted so that the

damaged areas could be repaired.

New Business

Standing Rule

 Ms. Rowell made the motion to pass the Standing Rule as follows:

COMMON AREA SECURITY

( c) The Board of Directors shall authorize one or more Directors, committee members and/or a private security

company to patrol the Common Properties to ascertain that all persons located on or using the Common

Properties are authorized to do so under the covenants, restrictions, By-Laws and Standing Rules governing the

Buena Vista Lakes Subdivision and the Association (collectively “Orange Book”), and to ascertain that there is

no behavior or activity being committed which is considered to be trespassing, disturbing the peace, violating

the Orange Book, or appearing to be illegal or dangerous to the community. Any unauthorized person or persons

found to be located on or using the Common Properties, together with failure to possess and/or show upon

request the identification established by the Orange Book, shall be considered to be trespassing on private

property. In any and all such events of such trespassing, behavior or activity disturbing the peace, violating theOrange Book, or appearing to be illegal or dangerous to the community, the patrolling person or other

authorized Director shall be and is hereby authorized and directed, at his or her discretion, to immediately call

the appropriate law enforcement authorities, and to take any and all legal action including, but not limited to,

having the violator(s) removed from the premises and signing and filing any official complaints, affidavits or

other documents required for prosecution under applicable laws.

 Mr. Donny Plunk seconded the motion. The motion passed 7-0.

President Email

 Ms. Vicki Moore made the motion to have an email set up so that residents may ask questions directly to the

president as a means to help with misinformation within the community. It was agreed that Ms. Ann Plunk

would monitor the emails and assist the president. Mr. Gatlin seconded the motion. The motion passed 7-0.

The motion was made and seconded to adjourn the meeting at 8:59 p.m.

The Board of Directors of Buena Vista Lakes Maintenance Association met September 16, 2020; at 7:00 p.m. Ned Plunk

called the meeting to order and Larry Moore led the assembly in prayer.

A roll call of board members was requested. Present were: Ned Plunk, Richard Gatlin, Donna Depukat, Donnie Plunk,

Vicki Moore, and Larry Moore. A quorum was established.

A motion was made and seconded that the BVL attorney be contacted and have him review the Orange Book and verify

if the association has the right to foreclose on outstanding property that is in arrears, if he suggests foreclosure on said

unpaid properties a letter is to be sent to lot xxx informing the owner that BVL is considering foreclosure for

nonpayment. The motion passed 5-0.

The board discussed the ongoing problems with ATV’s and the refusal of the DeSoto County Sheriff’s Department to

assist in resolving the problem. The board agreed that legal recourse be pursued.

The motion was made and seconded to adjourn the meeting.
