BUENA VISTA LAKES
MAINTENANCE ASSOCIATION, INC.DATE: December 12, 2022
The Board of Directors of Buena Vista Lakes Maintenance Association met on Monday November 7, 2022 at 7pm at the
clubhouse with Vice-President Vicki Moore presiding in the absence of President Ned Plunk.
A roll call of board members was requested, Vicki Moore, Nathan Naramore, Joel Bales, Janice Burchett, Kim Wood, Melanie
Turner, Jackie Hodges present and Ned Plunk, Moriah Mozingo, Leigh Cornish, Kyle Cornish absent. Board members Kevin
Cooper and Chris Vanelli have submitted their resignations to the board due to job travels and potential moving out of BVL.
A quorum was established with 7 members present.
Association members present were: Lindsey Ray, Donna Miller, Kathy Fink, Kyle Jones, Loretta Dickey, Barbara Campbell,
and Amber Smith Paulino.
Board Member Joel Bales led the group in prayer. A Benevolence collection was taken. Vicki Moore announced that
approximately $40 was spent on buying some winter under clothing and house slippers for local resident Ben Broersma.
MINUTES: The Minutes of the Monthly Meeting Minutes of September 12, 2022 were read and unanimously approved as
read following appropriate motion and seconded.
FINANCIAL REPORTS: The Monthly Financial Statement of October 2022 was reviewed. It was noted that there is an
invoice from Mr. Steve Wilson still awaiting approval. The motion was made to accept the financials with no changes. The
motion was seconded and passed unanimously.
Finance:
• Finance report as follows: No formal report, as Moriah Mozingo was absent (illness). Ongoing budget rewrites
due to proposed 2023 Budget not being funded at October 3, 2022 Annual Meeting.
Neighborhood Watch:
• Neighborhood Watch report as follows: We had a quiet month with 7 extra patrols, per Kim Wood. If you want to
see more deputies, you need to call in your issues and report situations.
Recreation (Pool, Ball field & Playground):
• Recreation report as follows: as per Jackie Hodges, she has been in touch with former director Larry Wilson for
updates on pool chemicals, etc. There will be a more detailed update in coming months, although it was noted that
the budget will be stretched to allow the pool to be open. It was also noted that we should investigate a
professional company for opening and closing the pool due to the tearing of the cover last month when covered by
volunteers.
Clubhouse:
• Clubhouse report as follows: Per Vicki Moore, we had a wedding reception at the Clubhouse last month following
the actual wedding on our new dock. Every Saturday in November is booked. The Ladies Club has cleaned out
the office space room and tidied up the kitchen. We found several old paint cans and will be disposing of them.
There are also old cameras and camera setup system to be disposed of.
Orange Book
• Orange Book report as follows: per Melanie Turner, no report due to ongoing lawsuit.
Beautification:
• Beautification report as follows: Beautification will be by committee for the time being; no report given.
Building Permits
• Building Permits report as follows: in the absence of Leigh Cornish, no report.
Greeter
• Greeter report as follows: Janice Burchett reported that she is updating the Quick Facts to hand out to new
residents as well as some HOA information. No Orange Books will be given out until after lawsuit is settled.Mowing & Grounds
• Mowing & Grounds report as follows: In the absence of Kyle Cornish, no report, although the mowing season is
officially over as of last month.
Maintenance: Lakes & Dams:
• Lakes & Dams report as follows: Joel Bales reported on the old pier at the foot of Black Panther Cove. It appears
to be somewhat stable although it needs a new ramp and needs some nails hammered down. Joel is unable to
work on this until January, so volunteers are needed and requested. Resident Donna Miller reported that she is
waiting on return phone calls as the the pier status from her point of view. She reported that per DeSoto County
standards and the State MS that no railing is required on docks. Since this pier is not unstable, it does not need to
be taken down. Ms. Miller will pay for an inspection by independent contractors but agreed that she will not
follow through on this if the board doesn’t plan to demolish the pier. Ms. Miller also offered to contribute
financially to the lumber needed for repairs, and offered the services of Mr. Lindsey Ray and her husband Mr.
Miller for repairs. They will use treated lumber, as it lasts longer. Ms. Miller also stated that the new pier will
NOT need to be stained and sealed as per her husband.
• Joel Bales and Nathan Naramore are continuing to consider the dam repairs needed in lieu of no increased budget.
They will begin a new game plan, which could include sand bags on standby for #3 dam in an emergency.
• Lengthy report by Joel Bales on the Area 51 Bike Trails, with community interest from Mr. Lindsey Ray. This is
Corps of Engineers land, and equipment has been parked there all summer. Joel has been in touch with the lake
manager of Arkabutla Lake, Dave Ross, who has been in touch with the owners of Area 51 Bike Trails. This is
their third bike trail although the first two were wiped out by severe weather in other states. Area 51 owners have
signed a contract with the Federal Government for access from Hwy 51 (Coldwater Bottom) to Hernando Point
campground. Joel talked with the area Park Ranger and walked some of the land and access points. All have
expressed a desire to work together to co-exist peacefully from all sides. The current HOA Board position is that
we are a single-access subdivision, one way in and one way out and we want it to stay that way. We are not an
avenue into a bike trail, nor are we a parking lot either on South Thunderbird or on Black Panther Cove. This
leads to safety issues for our homeowners, as well as parking/traffic on our already fragile levees, increased traffic
throughout the neighborhood, etc. The entire land donation to Area 51 Bike Trails was done without a public
hearing and Joel was told that since it is the Federal Government, they don’t need a hearing. That being said, all
sides still appear to want an amiable relationship. Joel has asked that “Out of Bounds” signs be posted for the
Area 51 bikers as the land approaches our subdivision. Mr. Lindsey Ray expressed concerns, as he has been
hunting in that property for over 20 years, and if a bike trail is placed, no hunting is allowed. Per Nathan
Naramore, the bike trails have already been placed, hence no hunting allowed. The director of Arkabutla will
meet with the owners of Area 51, and will then call a meeting between them and the HOA Board. They would
like to come to our December HOA Meeting, set for the second Monday night in December (December 12). Of
note – the Area 51 Bike Trails have had professional riders making promotional videos to be posted on their site,
advertising a “Buena Vista Connector”. Mr. Ray stated that in his opinion, it is critical to keep the bikers out of
our neighborhood as a safety issue and to prevent the building of parking lots adjacent to South Thunderbird and/
or Black Panther Cove. As per Joel, we need to look for a mutual respect relationship in which Area 51 Bikers
acknowledge that BVL Subdivision is out of bounds for them, they agree to limit access through BVL, and they
allow hunting in specified areas. Again, communications are ongoing, and they would like to come to the
December meeting.
• Joel stated that he has been approached by an outside interest to inquire whether BVL would entertain selling
fishing passes to non-residents. It is the studied opinion of the Board that this is not a good idea.
Ladies Club:
per Kathy Fink the dead tree behind the parking lots sheds has been removed and all stumps ground
and paid for by the Ladies Club. November 11 is the Veterans Day Brunch (all are welcome) ,
November 19 is the Holiday Frozen Casserole and Bake Sale; December 3 is the Christmas Potluck and Bingo;
December 1 is the day to decorate the clubhouse; December 8 is the day for delivering baskets to community
shut-ins.
Old Business:
Donna Miller requested an update on the current BVL lawsuit. A brief update from Joel Bales on the Board
position, including the fact that we have filed an appeal of the ruling of Judge Vicky Daniels from October 12,
2022. Ms. Miller sought input from Mr. Kyle Jones who had filed the lawsuit but he declined, stating that this
was his first hearing of the filing of appeal.
Mr. Kyle Jones requested a ruling from the HOA Board on his previous permit request for chicken coop. Afterdiscussion, Mr. Jones will confirm with DeSoto County whether they require a permit since this will be a
permanent structure. Mr. Bales requested that Mr. Jones provide a lot layout with the proposed location with
appropriate boundary allowances, etc. When all info is submitted, the Board can take a text vote for approval.
New Business:
Loretta Dickey requested Board permission to hold a “gender reveal” on the Green Duck levee on November 12
for a family member. Despite initial favorable impression, it was noted to be a “burnout powder reveal” involving
revving up a car to eject the colored powder. Since the Board continues to try to deal with loud and noisy
vehicles and racing cars, it as requested that the reveal be limited to a popping of a powder cylinder instead of
a burnout reveal. Ms. Dickey thanked the board for its consideration.
The motion was made and seconded to adjourn the meeting at 835pm.
