MAINTENANCE ASSOCIATION, INC.

The Board of Directors of Buena Vista Lakes Maintenance Association met on Monday June 5, 2023 at the
BVL clubhouse and was called to order at 7pm by President Ned Plunk. The opening prayer was led by Joel
Bales
A roll call of board members was requested. Members present were Joel Bales, Janice Burchett, Jeremy
Conlee, Leigh Cornish, Kathy Fink, Jackie Hodges, Vicki Moore, Ned Plunk, Melanie Turner, and Kim
Wood. Board members absent included Kyle Cornish, Chris Humphrey, and Nathan Naramore. A quorum
was confirmed.
Association members present were: Meagan Qualls (918 N Thunderbird), DeLynn Conlee (lot 499), Jo Ann
Yager (lots 88 & 89), Alex Waugh (lot 35) and Debra Holcomb.
A letter of resignation from Director Kyle Cornish (Mowing & Grounds) was turned in by Leigh Cornish,
effective 6/5/2023.
The Benevolence Fund has $840 as of tonight, with $54 added tonight for a total of $894 if anyone knows of
anyone in our community in need. (Check with Jackie and Bill Carson)
MINUTES: The Minutes of the Monthly Meeting Minutes of May 1, 2023 were reviewed. Motion was
made by Vicki Moore to approve the minutes as read; second by Kim Wood. Motion passed unanimously.
FINANCIAL REPORTS: The Monthly Financial Statement of April 2023 as provided by the Keith Collins
Management Company was reviewed. The motion was made by Vicki Moore to accept the financials with no
changes. The motion was seconded by Jeremy Conlee and passed unanimously.
Finance:
• Finance report as follows: Vicki Moore reported a current balance of approximately $91,000 with
$43,7771.79 in the Lakes & Dams account and $53,467.74 in the Operating Budget. There is
still $37,778.42 in outstanding dues owed with 24 demand letter sent by our attorney, 18 are in
collections, and there are 7 with liens on their property. We continue to budget money to do
upkeep, with a potential need for stain the new Green Duck Dock since that wood has now cured.
We have not transferred any money from the operating budget to the Lakes and Dams budget yet.
Neighborhood Watch:
• Neighborhood Watch report as follows: Kim Wood reported 71 extra patrols this past month
(these are “on their own” by the deputies and not in response to complaints and concerns called
in). Other calls included welfare check on Red Fox Cove, Potential pool trespassers, trespassers
on the Green Duck Levee, truck parked down low on Green Duck Levee causing damage (needs
to be reported to DCSO -Ann Plunk)
Recreation (Pool, Ball field & Playground):
• Recreation report as follows: Jackie Hodges had no update on the playground or the ball field.
The pool clean up day on May 6 went very well with lots of good help. The pool deck was
power washed by Cheryl Workman. A new pool rope has been purchased, new keys to the pool
shed and bathroom have been obtained. We need a repair of the lights in the pool shed – we have
three left over LED lights from the clubhouse – could these be used? The pool opening check list
has been fully completed, and three board member signatures are needed for sign off. (Ned,
Jackie, Melanie). We still need some shade for a majority of the day; the current umbrellas aren’t
stable as they aren’t anchored. Board member Melanie Turner donated heavy canvas shade sails
that need to be hung up. Community member Meagan Qualls asked about a wasp nest in the
pool bathroom and suggested perhaps hanging a fake hornets nest to discourage them. Mrs.
Qualls also mentioned teenagers in the pool area using foul language and smoking around the
younger children – anyone noticing this kind of behavior is welcome to call DCSO. Mrs. Qualls
then asked if the pool hours could be changed to 8am-8pm on Wednesdays and Saturdays for her
to teach swimming lessons to her children when there isn’t a crowd.Clubhouse:
• Clubhouse report as follows: Melanie Turner is the new Director for the clubhouse and reported
one rental for May. The AC thermostat appears to have been tampered with and Melanie
requested the clubhouse be rekeyed/locks changed immediately. DeLynn Conlee works for
locksmith and can send someone out to do this ASAP. There would be a minimum of $175 for
the visit, with $19.50 per keyhole and keys and since this will fall below $500, no further quotes
are required. Melanie also reported that the light fixture in the office room is falling out of the
ceiling and needs to be re-hung. Vicki Moore reported that the ductwork under the clubhouse is
still ongoing.
• Orange Book
• Orange Book report as follows: Any activity on the Orange Book remains tabled until the current
lawsuit is settled. The BVL portion of the appeal has been filed, as has Mr. Kyle Jones’ response.
The case is now in the hands of the appeals court. Once the current lawsuit is settled, the board
hopes to pursue a legal attorney-mediated re-write of the entire Orange Book, CCRs, bylaws, etc
which will update the document into the present times and be filed legally with the County and
the State. This will help avoid future lawsuits regarding our community CCRs and Bylaws.
Motion by Joel Bales to include a potential newly rewritten Orange Book in the August mail out
for the October Annual Meeting. Vickie Moore will check with attorney Palmertree for a time
frame for a complete re-write. Motion tabled for now.
Beautification:
• Beautification report as follows: Vicki Moore reported the property at 8870 Bob White is still a
serious concern. Two homeowners are reported to be living in RVs on their property, which is
not allowed by our bylaws. Vicki will investigate mailing more letters, and will contact Bennie
Hopkins.
Building Permits
• Building Permits report as follows: Leigh Cornish reported two permit requests for new resident
Greg Sellers at 739 N Thunderbird. Dock, picket fence, extending driveway. This was passed by
text vote due to his having workmen available to start immediately. Homeowner Alex Waugh
presented a request for a 24 x 18 driveway parking pad at 8697 Thunderbird Drive East. Motion
by Vicki Moore and seconded by Janice Burchett to grant the permit – passed unanimously.
Homeowner Joel Bales requested a permit for a movable chicken coop. Motion by Vicki Moore
and second by Jeremy Conlee to grant the permit; motion passed unanimously. Question was
raised about whether a permit was requested for a new porch on North Thunderbird – apparently
the answer is no.
Greeter
• Greeter report as follows: Janice Burchett reported attempting several home visits, but no one
came to the door. She requested that she be able to mail letters introducing herself and the HOA
Board, and provide the BVL Quick Facts. All were in agreement for letters initially instead of
visits.
Mowing & Grounds
• Mowing & Grounds report as follows: Director Kyle Cornish resigned effective tonight. The
mowing is ongoing per current contract. Vicki Moore will ask Chris Humphrey to move to the
director over Mowing until the Annual Meeting is completed.
Maintenance: Lakes & Dams:
• Lakes & Dams report as follows: Joel Bales brought up the need for a sea wall repair by the
Boat Ramp on N Thunderbird on Rain Cloud Lake. He suggested an action plan on alternating
years to lower water in a specific lake to allow homeowners to work on their docks and/or sea
walls. Joel also mentioned turning on the pump to the former swimming lake (Crossed Arrows
Lake) behind the clubhouse at a cost of $120/month for three months. Could Nathan Naramore
review the electrical switch on the pump? Is this pump separate from the other pumps, or would
all pumps need to be turned on? Motion by Vicki Moore to turn on the pump and allow the old
swimming lake to fill up. Motion was seconded by Jeremy Conlee and motion carried (see
clarification at the bottom of these minutes). Joel will request a dam person to manage quotes
for lowering individual lakes periodically, as well as quotes for repairs on Dam #3. The questionwas posed as to what else to use at the sea wall for the boat ramp area other than RR ties. Could
we send a blast text out via KCC to see what homeowners would be interested in lowering lakes
for sea wall/dock repairs to determine which lake to begin with first? Do we need to move
money from the Operating Budget to the Lakes and Dams account? Table this until the July
meeting; the repairs for Dam #3 will probably be in the range of $60,000-$70,000 which is not
currently available. Perhaps an assessment at October Annual Meeting? Jeremy Conlee reported
that for $530 we can purchase a 1” mesh, 100 yard long net with sinkers and floats to remove
some fish. This will also trap turtles, snakes, etc. Nathan has a method to use this net, leaving it
out overnight, and continuing to use it until the 25lb per acre of fish are removed. Motion by
Jeremy Conlee to purchase the net, seconded by Vicki Moore; vote was unanimous for purchase
of the net.
Ladies Club:
Kathy Fink reported lots of ongoing planning for the July 4th celebration. The Ladies Club will
manage the games. They will also have a snow cone machine, popcorn machine, and a cotton
candy machine and will need volunteers for these. Cakes will need to be donated for the cake
walk. The time is changed from parade at 6pm to parade at 3pm on the Green Duck Levee.
Amanda Thompson has a committee and is working on the details. As a reminder, the Ladies
Club no longer accepts rent for the sheds on the clubhouse parking lot; all proceeds go to KCC
for the clubhouse.
Unfinished Business:
1. No discussion of fish restock due to the absence of Nathan Naramore.
2. The Fishing Rodeo is tabled due to lack of interest.
3. We have a quote from a local company to re-stripe the clubhouse parking lot for $485. Motion
by Vicki Moore and seconded by Jeremy Conlee to proceed with this; motion passed
unanimously.
4. No quotes on gutters for the clubhouse yet.
New Business:
Jeremy Conlee reported on the meeting between NMTA and the Army Corps of Engineers held
on May 30, 2023. There will be no maintenance parking lots on S Thunderbird or behind Black
Panther Cover. We have been requested to send two people to a meeting in which the
Memorandum of Understanding will be revised again. Potential candidates include Jeremy
Conlee, Nathan Naramore, Joel Bales, and Ned Plunk. Rep. Trent Kelly suggested the wording
“in perpetuity” be included. His representative Adam Grubb visited BVL, and stated that our
roads are not biker friendly due to many hills and curves and no bike lanes. Should we ask
Donna Miller to attend as a note taker? Janice Burchett suggested that we record the meeting,
but the Board no longer has a recording device. For now, Jeremy and Nathan will be our primary
contacts with Joel and Ned as alternates. All language in the Memorandum will be effective
immediately. Mr. Robert Jarman with DeSoto County Roads has offered to place road signs (No
Parking) whenever the board notifies him of exactly what they want.
Motion by Jeremy Conlee to appoint DeLynn Conlee as Interim Director over Beautification and
Sanitation. Seconded by Jackie Hodges and passed unanimously.
Motion by Vicki Moore to move all 10 day overdue accounts to collections by our attorney.
Seconded by Melanie Turner and passed unanimously.
CLARIFICATION: Until clarification by our insurance company, all lakes will remain status of
NO SWIMMING.
Motion by Vicki Moore to adjourn the meeting at 940pm. Seconded by Jeremy Conlee and passed unanimously.
